After an unsuccessful attempt to overturn a ban on its latest Apple Watches, Apple has announced its intention to commence sales of the Apple Watch Series 9 and Apple Watch Ultra 2, excluding the blood oxygen monitoring functionality, starting January 18th.

These modified versions of the watches will be accessible for purchase on Apple’s official website from 9 AM ET and will also be available in Apple’s brick-and-mortar stores. For users who already own an Apple Watch equipped with the blood oxygen feature, Apple assures that there will be no changes to the functionality of their devices.

Recent court documents revealed that US Customs has greenlit versions of the Apple Watches that lack blood oxygen capability. Bloomberg reports that Apple has devised a software solution to address this issue.

Apple’s Full Statement on the Matter

That said, here is the full statement by Apple from Nikki Rothberg, Apple’s spokesperson:

“Apple’s appeal is ongoing, and we believe the US Court of Appeals for the Federal Circuit should reverse the USITC’s decision. We strongly disagree with the USITC decision and resulting orders.

Pending the appeal, Apple is taking steps to comply with the ruling while ensuring customers have access to the Apple Watch with limited disruption. These steps include introducing a version of the Apple Watch Series 9 and Apple Watch Ultra 2 in the United States without the Blood Oxygen feature. There is no impact on Apple Watch units previously purchased that include the Blood Oxygen feature.

Apple Watch Series 9 and Apple Watch Ultra 2 without the Blood Oxygen feature will become available from apple.com starting 6 AM PT on January 18 and from Apple Stores starting January 18.”
